Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Interviewology.ai website, applications, APIs, and related services (collectively, the "Services") provided by Interviewology LLC, a Delaware C corporation ("Interviewology," "we," "our," or "us"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility & Accounts

You must be at least 18 years of age and capable of entering a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use.

2. The Services

Interviewology provides an AI-assisted interview intelligence platform that helps organizations structure interviews, capture evidence, and synthesize hiring decisions. We may modify, suspend, or discontinue any portion of the Services at any time. Some features are offered under different subscription tiers (e.g., Free, Pro, Premium) and may be subject to additional terms or order forms.

3. Customer Data

"Customer Data" means any data, content, or materials you or your authorized users submit to the Services, including candidate information, interview notes, recordings, transcripts, and rubric responses. As between you and Interviewology, you retain all rights in Customer Data. You grant Interviewology a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and otherwise use Customer Data solely to provide and improve the Services and as permitted by these Terms and our Privacy Policy.

You represent and warrant that you have all necessary rights, consents, and lawful bases to provide Customer Data to Interviewology, including any consents required from candidates or interviewers under applicable law.

4. Acceptable Use

You agree not to, and not to permit any third party to:

  • Use the Services in violation of any applicable law, regulation, or third-party right;
  • Use the Services to make a final, automated employment decision without meaningful human review;
  • Upload material that is unlawful, defamatory, infringing, harassing, or that contains malware;
  • Reverse engineer, decompile, or attempt to derive source code or underlying models from the Services, except as expressly permitted by law;
  • Resell, sublicense, time-share, or use the Services for the benefit of any third party outside your organization without our written consent;
  • Probe, scan, or test the vulnerability of the Services, or breach security or authentication measures;
  • Use the Services to train competing AI models or interview-intelligence products.

5. AI-Assisted Output

The Services use artificial intelligence to generate summaries, scoring suggestions, bias flags, and similar output ("AI Output"). AI Output is provided as a decision-support aid only. You are solely responsible for any hiring or employment decision you make. You acknowledge that AI Output may be inaccurate, incomplete, or unsuitable for a particular use, and that similar or identical output may be generated for other customers.

6. Subscriptions, Fees & Taxes

Paid Services are billed in advance on a recurring basis (monthly or annual) according to the plan you select or the order form you sign. Except as required by law, fees are non-refundable. We may change pricing on renewal with at least thirty (30) days' notice. You are responsible for any sales, use, value-added, or similar taxes other than taxes on Interviewology's net income. If payment is overdue, we may suspend the Services after reasonable notice.

7. Free Tier & Beta Features

Free, trial, or beta features are provided "AS IS" and "AS AVAILABLE," without warranty of any kind. We may modify or discontinue them at any time without liability.

8. Intellectual Property

Interviewology and its licensors retain all right, title, and interest in and to the Services, including all software, models, documentation, and trademarks. No rights are granted to you other than the limited, non-exclusive, non-transferable, revocable right to use the Services in accordance with these Terms.

If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use them for any purpose without obligation to you.

9. Confidentiality

Each party may receive non-public information of the other ("Confidential Information"). The receiving party will use the same degree of care it uses for its own confidential information (and no less than reasonable care), will not disclose it except to personnel with a need to know who are bound by similar obligations, and will use it only to perform under these Terms. These obligations do not apply to information that becomes public through no fault of the receiving party, was independently developed, or must be disclosed by law.

10. Privacy & Data Protection

Our processing of personal data is described in our Privacy Policy. If you require a Data Processing Addendum (e.g., for GDPR or CCPA compliance), contact us at legal@interviewology.ai.

11. Third-Party Services

The Services may integrate with third-party products such as Google Workspace, Microsoft 365, applicant tracking systems, and payment processors. Your use of those products is governed by their own terms, and Interviewology is not responsible for them.

12. Term & Termination

These Terms remain in effect while you use the Services. Either party may terminate for material breach if the breach is not cured within thirty (30) days of written notice. We may suspend or terminate the Services immediately if we reasonably believe your use poses a security risk or violates law. Upon termination, your right to use the Services ends and we may delete Customer Data after a reasonable retention period, subject to legal obligations. Sections that by their nature should survive termination (including Sections 3, 8, 9, 13, 14, 15, and 17) will survive.

13. Disclaimer of Warranties

Except as expressly provided, the Services and all AI Output are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

14. Limitation of Liability

To the maximum extent permitted by law, in no event will Interviewology be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to these Terms or the Services, even if advised of the possibility of such damages. Interviewology's aggregate liability for any claim arising out of or related to these Terms will not exceed the greater of (a) the amounts you paid to Interviewology for the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

15. Indemnification

You will defend, indemnify, and hold harmless Interviewology and its affiliates, officers, directors, employees, and agents from and against any third-party claims, damages, and expenses (including reasonable attorneys' fees) arising out of: (i) your Customer Data; (ii) your violation of these Terms or applicable law; or (iii) your hiring or employment decisions made in reliance on the Services or AI Output.

16. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms with a new effective date and, where appropriate, by email. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

17. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. The state and federal courts located in New Castle County, Delaware will have exclusive jurisdiction over any dispute arising out of or related to these Terms, and each party consents to personal jurisdiction and venue there. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

18. General

These Terms, together with any order form or addendum, constitute the entire agreement between the parties regarding the Services and supersede all prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
